1. AGREEMENT TO TERMS

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and RB VENTURES, a company registered in Estonia, with registered address at Salu tee 5, Tartu, Estonia ("Company," "we," "us," or "our").

By accessing our website vianthe.com (the "Site"), placing an order, or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Site or purchase our products.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site after changes are posted constitutes acceptance of the modified Terms.

2. ELIGIBILITY

You must be at least 18 years old to purchase from our Site. By placing an order, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this agreement.

If you are accessing the Site or making purchases on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

3. PRODUCTS AND SERVICES

3.1 Product Descriptions

We attempt to be as accurate as possible in describing our products. However, we do not warrant that product descriptions, images, pricing, or other content on the Site is accurate, complete, reliable, current, or error-free.

3.2 Product Availability

All products are subject to availability. We reserve the right to discontinue any product at any time without notice. We cannot guarantee that products will be in stock at the time of your order.

3.3 Pricing

All prices are displayed in USD (United States Dollars) and are subject to change without notice. We reserve the right to correct pricing errors on our Site or on pending orders.

If a product is listed at an incorrect price due to an error, we reserve the right to refuse or cancel any orders placed for that product, whether or not the order has been confirmed and your payment processed.

3.4 Medical Disclaimer

IMPORTANT: Our products are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

The Vianthe HeatWave™ Neck Warmer is a consumer wellness product designed for temporary relief of minor aches and pains. It is not a substitute for professional medical advice, diagnosis, or treatment.

You should consult your physician before using this product if you:

  • Have any medical condition (including diabetes, neuropathy, circulatory disorders, or cardiovascular disease)
  • Are pregnant or nursing
  • Are taking prescription medications
  • Have reduced heat sensitivity or sensation
  • Have open wounds or skin conditions
  • Are under 18 years of age
  • Have a pacemaker or other implanted medical device

For medical emergencies, contact your healthcare provider or emergency services immediately.

4. ORDERS AND PAYMENT

4.1 Order Acceptance

Your order is an offer to purchase products from us. We reserve the right to accept or reject any order for any reason, including but not limited to product availability, errors in product or pricing information, suspected fraud, or other reasons at our sole discretion.

Order confirmation does not constitute our acceptance of your order. We reserve the right to cancel any order after confirmation has been sent.

4.2 Payment

Payment must be made at the time of purchase using one of our accepted payment methods. By submitting payment information, you represent that you are authorized to use the payment method and authorize us to charge the total amount to that payment method.

We use third-party payment processors and do not store your complete payment card information on our servers.

4.3 Currency and Taxes

All prices are in USD. Customers are responsible for any applicable customs duties, import taxes, or other fees imposed by their country. These fees are not included in our product prices or shipping costs and are the customer's sole responsibility.

5. SHIPPING AND DELIVERY

5.1 Shipping Timeframes

We aim to process orders within 1-3 business days. Shipping times vary by destination and typically range from 5-15 business days for international orders.

Delivery timeframes are estimates only and are not guaranteed. We are not responsible for delays caused by customs, postal services, weather, or other factors beyond our control.

5.2 Shipping Costs

Shipping costs are calculated at checkout. Free shipping is available on orders over $50 USD to select countries.

5.3 Risk of Loss

Title and risk of loss pass to you upon delivery to the shipping carrier. We are not responsible for lost, stolen, or damaged packages once they have been delivered to the carrier.

5.4 Address Accuracy

You are responsible for providing accurate shipping information. We are not responsible for orders shipped to incorrect addresses provided by the customer. Address changes or corrections may incur additional fees.

6. RETURNS AND REFUNDS

6.1 90-Day Money-Back Guarantee

We offer a 90-day money-back guarantee from the date of delivery. If you are not satisfied with your purchase, you may request a refund within 90 days.

To be eligible for a refund:

  • Request must be made within 90 days of delivery
  • Product must be in its original condition (unless defective)
  • You must provide proof of purchase
  • Return shipping costs are the customer's responsibility (except for defective products)

6.2 Defective Products

If you receive a defective product, contact us within 30 days of delivery. We will provide a prepaid return label and issue a full refund or replacement at our discretion. You may keep defective products and are not required to return them.

6.3 Refund Processing

Approved refunds will be processed within 5-10 business days of receiving the returned product (or approval for defective products). Refunds will be issued to the original payment method.

We reserve the right to refuse refunds for products that show signs of misuse, abuse, or damage not resulting from defects.

6.4 Return Address

Returns must be sent to the address provided by our customer service team. Do not return products without first contacting us for authorization.

7. INTELLECTUAL PROPERTY

7.1 Ownership

All content on the Site, including but not limited to text, graphics, logos, images, audio clips, video, data compilations, and software, is the property of RB VENTURES OÜ or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes. You may not:

  • Modify, copy, distribute, transmit, display, reproduce, publish, license, or create derivative works from Site content
  • Use Site content for commercial purposes
  • Remove any copyright, trademark, or other proprietary notices
  • Use automated systems (bots, scrapers) to access the Site
  • Reverse engineer or attempt to extract source code from the Site

8. USER CONDUCT

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms

  • Transmit viruses, malware, or other harmful code

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • The Site will be uninterrupted, secure, or error-free
  • Products will meet your specific requirements
  • Product results will be as expected
  • Any errors will be corrected

9.2 Limitation of Liability

IN NO EVENT SHALL RB VENTURES OÜ, ITS DIRECTORS, EMPLOYEES, AFFILIATES, OR SUPPLIERS BE LIABLE FOR:

  • ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, REVENUE, DATA, OR USE
  • PERSONAL INJURY OR PROPERTY DAMAGE (EXCEPT WHERE PROHIBITED BY LAW)
  • ANY DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE OR PRODUCTS

OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE OR PRODUCTS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM, OR €100, WHICHEVER IS LESS.

9.3 Exceptions

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

10. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless RB VENTURES OÜ, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Site or products
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Your violation of any applicable laws or regulations

11. THIRD-PARTY LINKS AND SERVICES

The Site may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of third-party sites. Your use of third-party sites is at your own risk and subject to their terms and conditions.

We use third-party payment processors and shipping carriers. We are not liable for the acts or omissions of these third parties.

13. DISPUTE RESOLUTION

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Estonia, without regard to its conflict of law provisions.

13.2 Jurisdiction

Any disputes arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of Tartu, Estonia.

13.3 Informal Resolution

Before filing any formal legal action, you agree to first contact us at hello@vianthe.com to attempt to resolve the dispute informally. We will attempt to resolve disputes in good faith.

13.4 Time Limitation

Any claim or cause of action arising from these Terms or your use of the Site must be filed within one (1) year after the claim or cause of action arose, or it will be permanently barred.

14. FORCE MAJEURE

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

15. SEVERABILITY

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

16. WAIVER

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of RB VENTURES OÜ.

17. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any other policies posted on the Site, constitute the entire agreement between you and RB VENTURES OÜ regarding your use of the Site and supersede all prior agreements and understandings.

18. ASSIGNMENT

You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may assign these Terms without restriction.

19. SURVIVAL

Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

21. PRODUCT-SPECIFIC TERMS

21.1 Proper Use

The Vianthe HeatWave™ Neck Warmer is intended for external use only on the neck and shoulder area. Do not use:

  • While sleeping (unless under medical supervision)
  • On broken, irritated, or infected skin
  • With topical heating creams or ointments
  • In combination with other heating devices
  • If you cannot feel heat or pain normally
  • On children under 18 without medical supervision

21.2 Safety Warning

BURN RISK: Improper use may cause burns. Always start with the lowest heat setting. Do not use for more than 60 minutes per session. Allow skin to cool between sessions.

FIRE RISK: Do not use near flammable materials. Do not cover the device with blankets or pillows while in use. Unplug when not in use.

21.3 Electrical Safety

Use only with approved USB power sources (5V/2A). Do not attempt to repair or modify the device. Discontinue use if the cord, controller, or heating element shows any damage.

22. CUSTOMER REVIEWS AND CONTENT

22.1 User-Generated Content

By submitting reviews, testimonials, photos, or other content to our Site, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, publish, and distribute such content for any purpose.

22.2 Content Guidelines

You represent that any content you submit:

  • Is accurate and truthful
  • Does not violate any third-party rights
  • Does not contain offensive, defamatory, or illegal material
  • Complies with all applicable laws
